Assemblyman Brian Curran of Lynbrook-21st A.D. has announced his intention to co-sponsor a proposal aimed at helping survivors of sexual violence achieve justice. The proposal, known as A.4992, would permit the introduction of evidence relating to an individual's previous sexual offenses in a sexual offense proceeding.
Curran believes that this legislative change would enable juries to gain a more comprehensive understanding of a defendant's past actions and ensure they have access to all pertinent evidence. "It is a fact that most of those convicted of rape are serial criminals, but currently, evidence of these repeated instances of sexual violence is not allowed in court. This is plain wrong, a defendant's criminal history must be allowed to be taken into consideration," said Curran.
The assemblyman further argued that prosecutors should be able to utilize such evidence rather than solely relying on the survivor's testimony and courage. "Prosecutors must be allowed to use this evidence, so as not to be forced to solely rely on the bravery and testimony of a survivor," he stated.
Expressing his support for the proposal, Curran affirmed his commitment towards ensuring victims receive the justice they deserve. "I am proud to support this proposal and will always work to make sure victims receive the justice they deserve,” he added.
