Assemblyman Brian Curran (Lynbrook- 21st A.D) has announced his co-sponsorship of a proposal aimed at protecting sexual assault survivors. The proposal, known as A.1065, seeks to eliminate the voluntary incapacitation loophole in sexual assault cases, preventing the use of intoxication of the victim as a defense for sex crimes.
Under the current law, individuals incapacitated as a result of their own actions are not protected under the rape statute. Curran argues that this loophole must be addressed to bring justice to victims who might otherwise be denied it. He stated, "It is outlandish that law is even on the books to begin with, to deny someone justice because they were intoxicated is just plain wrong. Rape is rape no matter what, let me be abundantly clear on that, and the fact some perpetrators can get away with it because the victim was intoxicated is nothing short of shameful. For that reason, I am proud to help right this wrong and close this ridiculous loophole."
Curran's initiative aims to modernize state law and ensure that perpetrators do not evade accountability by exploiting such loopholes. By supporting this proposal, Curran is taking a stand to rectify an injustice and provide greater protection for survivors of sexual assault.
